10BIT LABS LTD, trading as Plan The Day ("Plan The Day", "we", "us" or
"our"), provides the Plan The Day website, web application and related
services. These Terms & Conditions govern your use of those services.
By creating an account, using Plan The Day or purchasing a paid product, you
agree to these Terms. If you do not agree, do not use Plan The Day.
About Plan The Day
Plan The Day is an event-planning application. It lets authorised users create
and manage Events, including Event details, Timeline Items, Suppliers, contacts
and Contracts, and share selected Event information with authorised
collaborators.
Plan The Day is a planning tool. We do not provide event-planning,
professional, financial, legal, insurance, Supplier, venue or contracting
advice. We are not a party to any agreement between you and a Supplier,
collaborator, venue or other third party.
Your account
You must provide accurate and current information when you create or manage an
account. You are responsible for keeping your sign-in details secure and for
activity carried out through your account.
Tell us promptly if you believe your account has been accessed without your
permission.
You must be legally able to enter into these Terms. If you use Plan The Day for
an organisation or another person, you confirm that you have authority to
accept these Terms on their behalf.
You must be at least 18 years old to create an account, purchase a paid product
or use Plan The Day.
Using Plan The Day
We grant you a personal, limited, non-exclusive, non-transferable and
revocable right to use Plan The Day in accordance with these Terms.
You must not:
- use Plan The Day unlawfully or in a way that infringes another person's
rights;
- attempt to gain unauthorised access to accounts, Events, systems or data;
- interfere with, damage or disrupt Plan The Day or its security;
- upload malware or harmful code;
- use Plan The Day to send spam or misleading invitations;
- copy, sell, rent, reverse engineer or commercially exploit Plan The Day,
except where law prevents us from restricting that activity; or
- use Plan The Day in a way that could harm us, other users or third parties.
We may suspend or restrict access where reasonably necessary to protect Plan
The Day, our users or third parties, investigate suspected misuse, comply with
law or carry out maintenance. Where appropriate, we will explain the reason and
restore access when the issue is resolved.
Your Event information and shared access
You retain ownership of the information and files you add to Plan The Day.
You give us the limited rights needed to host, store, process, display and
transmit that information solely to operate, secure, support and improve Plan
The Day in accordance with our Privacy Policy.
You are responsible for the information you add, including information about
Suppliers, contacts, collaborators and other people. You must have the right to
add and share that information, and you must give any privacy information or
obtain any permissions required by law.
You are responsible for choosing who can access an Event and for reviewing or
revoking access when it is no longer appropriate. People with access to an
Event may be able to view the information made available to their role.
Paid products and payments
Plan The Day may offer paid products, including Event Pass and Planner Pro.
The price, currency, billing period, applicable taxes and key features of a
paid product will be shown before you complete payment. The information shown
at checkout forms part of your purchase.
Payments are processed by Stripe or another payment provider we make available.
We do not store your full payment-card details.
Event Pass costs £59.00. Planner Pro costs £24.99 per month. Prices are shown
in pounds sterling. We are not VAT registered and do not charge VAT.
Event Pass
Event Pass is a one-off purchase that removes the applicable planning limits
for the Event connected to the purchase.
An Event Pass is linked to that Event only. It cannot be transferred to another
Event, account or replacement Event. Deleting the Event also removes its Event
Pass. Paid access begins after Stripe has successfully processed payment.
Planner Pro
Planner Pro is a recurring monthly subscription for eligible Event Planner
accounts. There is no trial. It gives the account the paid access and planning
capability described at checkout while the subscription remains active.
Planner Pro renews automatically at the billing interval shown at checkout
unless you cancel it through the subscription-management route we provide,
currently Stripe Billing Portal.
If you cancel, Planner Pro remains available until the end of the current paid
billing period unless Stripe or law provides otherwise. Planner Pro paid
features and Event-management access may pause if payment fails, the
subscription expires, is cancelled or is otherwise no longer active.
Cancellation, cooling-off rights and refunds
We do not offer discretionary refunds for Event Pass, or pro-rata refunds for
Planner Pro after paid access has started or a subscription has been cancelled.
This does not affect any statutory cancellation, refund or other rights you may
have as a consumer.
Where you have a right to cancel, obtain a refund or receive another remedy
under applicable law, we will provide that remedy in accordance with the law.
To cancel Planner Pro, use the subscription-management route available in your
account. To ask about an Event Pass, a payment or a refund, contact us using the
details below.
Availability and changes
We aim to keep Plan The Day available and secure, but we do not guarantee that
it will always be uninterrupted, error-free or available at a particular time.
We may update Plan The Day to improve performance, security, functionality or
legal compliance. If a change materially reduces a paid product's core
functionality, we will give reasonable notice where practical and required by
law.
We may discontinue a feature or service for a valid business, legal, security
or technical reason. If this materially affects a paid product, we will give
reasonable notice where practical and consider any remedy required by law.
Third-party services
Plan The Day may link to or use third-party services, including Stripe for
payments and services selected by users, such as Suppliers or venues.
We are not responsible for third-party services, their content, availability,
terms, privacy practices, products or agreements. Your use of a third-party
service may be subject to that third party's terms.
Intellectual property
We and our licensors own the intellectual-property rights in Plan The Day,
including its software, branding, design and content, excluding information you
or other users provide.
You may not use our name, branding or materials without our prior written
permission, except as permitted by law.
Our responsibility to you
We do not exclude or limit liability where it would be unlawful to do so. This
includes liability for fraud, fraudulent misrepresentation, death or personal
injury caused by our negligence, or for your legal rights in relation to
services or digital content.
Subject to the above, we are responsible for losses that are a foreseeable
result of our breach of these Terms or failure to use reasonable care and skill.
We are not responsible for losses that are not foreseeable, losses caused by
events outside our reasonable control, or losses caused by your misuse of Plan
The Day.
Ending these Terms
You may stop using Plan The Day at any time. You may request deletion of your
profile through the application where you are eligible to do so.
Deleting an account or Event can affect access to Event information and paid
products. Before deleting, you should download or retain any information you
need.
We may end or suspend your access if you seriously or repeatedly breach these
Terms, misuse Plan The Day, create legal or security risk, or where required by
law. We will give reasonable notice where appropriate, unless immediate action
is necessary.
Ending these Terms does not affect rights or obligations that arose before they
ended.
Changes to these Terms
We may update these Terms to reflect changes to Plan The Day, our paid products,
the law or our business.
For material changes, we will give reasonable notice where practical. The
updated Terms will apply from the stated effective date. If you do not agree to
a material change, you may stop using Plan The Day and cancel any subscription
in accordance with these Terms and your legal rights.
Other important terms
If any part of these Terms is unenforceable, the rest will remain in force.
If we delay enforcing a right, that does not mean we have waived it.
These Terms are governed by the law of England and Wales. If you are a
consumer, you may also have mandatory rights under the law of the country where
you live.
The courts of England and Wales will have non-exclusive jurisdiction, meaning
that consumers may be able to bring a claim in the courts of their home
jurisdiction where applicable.
